The former mayor of Thunder Bay, Ont., has lost his appeal of his conviction for shooting a Black Panther activist in 1972.

Kirk LaPointe, 68, was elected mayor in 1974 and served until 1991, when he resigned in the face of an investigation into a physical altercation with a Thunder Bay councilwoman.

During that investigation, he was also charged with the July 27, 1972, shooting of a Black Panther at a downtown parking lot. LaPointe shot and killed Larry Christison, a spokesperson for the party, who had a water pistol in his hand at the time.

Lorne Gilbert, a student activist who later joined the party, also died of gunshot wounds. Gilbert was 19, and lived in the area of the shooting.

His wife, Elaine, and sister, Ella Newell, were wounded. The bullet that killed Gilbert is still inside Newell, who received a life sentence and was released in 2010, after serving 27 years.

LaPointe was charged but not convicted of manslaughter because of insufficient evidence. In a case that went to the Supreme Court of Canada, the federal government argued that the evidence was insufficient because the shooting was in the line of duty and in the heat of argument.

In a 3-0 decision, the court upheld the conviction.

LaPointe, who is white, argued in his appeal that he used excessive force during the altercation in question, and that charges should have been laid against the man he later killed.

His lawyers said the shooting occurred during a confrontation where LaPointe, who was then a municipal councillor, was trying to eject demonstrators from a town council meeting.

During the trial, he said he was provoked by what he said was insulting language by the demonstrators. He also described his former police officer son, Robert, as a “filthy, racist rat.”
